Framework Adjustment 42 implemented measures that allow vessels on trips declared to the Eastern U.S./Canada Area (Area 2) to also fish in the Western Area (Area 4) (Flex West) or to fish in Area 4 and outside the U.S./Canada Area (Flex Open) on the same trip. Framework Adjustment 42 also specified that all cod, haddock, and yellowtail flounder caught on these trips would be counted against the U.S./Canada hard total allowable catch (TAC). On January 26, 2009, Framework Adjustment 42 was suspended by Court Order. A subsequent Court Order on February 17, 2009, reinstated most provisions of Framework 42 including the option to Flex out of Area 2. Therefore, from January 26 through February 16, 2009, cod reported as caught under any of the Area 2 Flex codes have been attributed to the reported statistical area and only count against the hard TAC if caught within the appropriate stock area.
