Loligo/Butterfish Moratorium Permits - Qualified Vessels

Dear Permit Holder:

New regulations implementing Amendment 5 to the Fishery Management Plan for the Atlantic Mackerel, Squid and Butterfish Fisheries (Amendment) go into effect on January 1, 1997. There are two new types of Federal SMB permits, Limited Access and Open Access. Also, there are several permit categories associated with these permit types. You will soon receive your 1997 Vessel Renewal Application. The following summarizes the permit changes for the Atlantic Mackerel, Squid and Butterfish Fisheries which I hope will be helpful to you in selecting your new permit category for the 1997 fishing year.


Loligo/Butterfish Moratorium: This Amendment introduces a moratorium (limited access) permit for Loligo squid, and butterfish that will allow a vessel to harvest, possess, or land more than 2,500 pounds of Loligo squid or butterfish on a single trip. To be eligible for the moratorium permit, a vessel must have landed at least 20,000 pounds of Loligo squid or butterfish, or combination thereof, in any thirty consecutive-day period from August 13, 1981, through

August 13, 1993.

NMFS records show that the vessel named on the envelope did land more than 20,000 pounds of Loligo squid or butterfish during the appropriate time period. Therefore, you need not send proof of landings. However, when you receive your 1997 Vessel Renewal Application, you must select the new Loligo/Butterfish Moratorium permit category and return the completed application to our office to be eligible to obtain a 1997 Loligo/Butterfish Moratorium permit.

We must receive a completed application no later than May 2, 1997, or your vessel will be eliminated from consideration for the moratorium permit.


Loligo/Butterfish Incidental Catch: Any vessel of the United States may obtain this permit to fish for or retain up to 2,500 pounds each of Loligo squid and butterfish as an incidental catch in another directed fishery in the EEZ.

Atlantic Mackerel/Illex Squid: Any vessel of the United States may obtain this permit to fish for or retain Atlantic mackerel or Illex squid in or from the EEZ.

Please be advised that during the 1997 fishing year, an Illex squid moratorium permit requirement may be implemented which will establish eligibility requirements for this fishery.

Squid/Mackerel/Butterfish Party and Charter boat: The owner of any party or charter boat must obtain a permit to fish for, or retain in or from the EEZ, Atlantic mackerel, squid or butterfish while carrying passengers for hire.

Because of the extent of these new regulations, I encourage you to keep this letter handy for future reference. However, this letter is only a summary of the permit changes established under this Amendment. There are other requirements that have not been summarized in this letter.
